“Owaisi’s question – Can the President take resignation from the PM?”

All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi on Monday questioned the recently introduced bills to remove the Prime Minister, Chief Ministers and Ministers, asking whether the President can actually take resignation from the Prime Minister. The Hyderabad MP said that the Constitution states that the President will be guided by the aid and advice of the Council of Ministers. He argued that the proposed bill gives the President the power to remove the Prime Minister, which is contrary to the existing law.

Speaking to the media, Owaisi said that we have said in the Constitution that the President of India will be guided by the advice and aid of the Council of Ministers. This article is in the Constitution. This proposed bill is saying that the President can remove the Prime Minister. What is this? This is clearly contrary to that article. He further asked, can a President really make the Prime Minister resign?

The bill, which has been sent to the Joint Parliamentary Committee, has a provision to remove the Prime Minister or Chief Minister who is facing charges of serious crimes and has been in jail for 30 consecutive days. He also raised concerns over the powers of state governments and said that if the central government decides to arrest four or five state ministers, the state government will automatically fall.

Where is the freedom? You will control them yourself… Just arrest four or five ministers and the government will go. Introducing the bill in Parliament last week, Owaisi said the government was hell-bent on creating a police state and the bill would be the death knell for the elected government. Owaisi further said the bill violates the principle of separation of powers and undermines the people’s right to choose a government.
